Estate registration formalities will increase the security of trade and the development of the economic system. In order to do such a ceremony, the first step is to identify the property to be registered in the legal system. In Iranian law, public property is not allowed to be owned and in English law, in addition to the public property, the property belonging to the Queen is also not capable of being registered. Estate registration in addition to cause the security of exchange can reduce the claims related to estates in the courtroom and has some effects Such as tax breaks in cases of natural transference, identification of the individual's legal ownership, entry into force, the inability of the arbitrator to conflict with the provisions of the document and the impossibility of eliminating the validity of the document, but with the court's ruling. The registration of property and the official identification of the ownership of a person on his property is also considered one of the infrastructure for the establishment of smart contracts in the legal system. Smart contracts are the most advanced type of electronic contracts, where the contractor replaces the state-identified property or the digital cryptocurrencies. In common law, the allocation of digital signatures to individuals is subject to the identification of his identity and assets. Therefore, property registration in the allocation of digital signatures to individuals is also used as a license to conclude these contracts.}, keywords = {Property,Land Registration,Smart Contracts,Blockchain,cryptocurrencies}, title_fa = {مطالعه تطبیقی ضرورت ثبت املاک در امکان‌سنجی برقراری قراردادهای هوشمند در حقوق ایران و انگلستان}, abstract_fa = {توسعه نظام ثبتی یکی از ضروریات توسعه سایر نظامات در هر کشور تلقی می‌گردد. انجام تشریفات ثبت املاک موجب افزایش امنیت مبادلاتی و توسعه نظام اقتصادی می‌باشد. جهت انجام چنین تشریفاتی در وهله اول نیاز به شناسایی املاک قابل ثبت در نظام حقوقی می‌باشد. در حقوق ایران اموال عمومی که تحت مالکیت عموم بوده قابلیت تملّک نداشته و در حقوق انگلستان علاوه بر اموال عمومی، اموال متعلق به ملکه نیز قابلیت ثبت ندارند. ثبت املاک علاوه بر ایجاد امنیت مبادلاتی موجب کاهش دعاوی مرتبط با املاک در دادگستری شده و دارای آثاری همچون معافیت مالیاتی در موارد انتقال قهری، شناسایی مالکیت رسمی فرد، لازم‌الاجرا بودن، عدم امکان مغایرت رأی داور با مفاد سند و عدم امکان از بین بردن اعتبار سند جز با حکم دادگاه می‌باشد. ثبت املاک و شناسایی رسمی مالکیت یک فرد بر مایملک خود یکی از زیرساخت‌های برقراری قراردادهای هوشمند در نظام حقوقی نیز تلقی می‌گردد. قراردادهای هوشمند، پیشرفته‌ترین نوع قراردادهای الکترونیکی می‌باشند که عوض قراردادی در آن‌ها املاک شناسایی شده توسط دولت یا ارزهای رمزنگاری شده دیجیتالی می‌باشد. در حقوق غرب تخصیص امضای دیجیتال به افراد منوط به شناسایی هویت و دارایی‌های وی می‌باشد  بنابراین ثبت املاک در تخصیص امضای دیجیتال به اشخاص نیز به‌عنوان مجوز انعقاد این قراردادها کاربرد دارند.}, keywords_fa = {مال,ثبت ملک,قراردادهای هوشمند,بلاک چین,ارزهای رمز نگاری‌شده}, url = {https://www.mo-lawresearch.ir/article_69909.html}, eprint = {https://www.mo-lawresearch.ir/article_69909_fbd5aefd6475d6dc8f0a36f918130842.pdf} }
