تحقیقات دیوان کیفری بین‌المللی در وضعیت کنگو و چالش‌های آن؛ از تکالیف دادستان دیوان کیفری تا نقش مُخبرین

چکیده

دادستان کیفری بین‌المللی در تحقیقات در وضعیت کنگو، رویکرد بی‌سابقه‌ای را اتخاذ کرد. دادستان ترجیح داد برای تحقیقات به‌جای استفاده از پرسنل دادسرا، از مخبرین بهره گیرد. ازاین‌رو با آنها وارد مذاکره و تنظیم قرارداد محرمانه شد. دادستان ضمن این قرارداد دو شرط؛ حفظ محرمانگی اطلاعات و منابع قرارداد و استفاده از دلایل مخبرین در پیشبرد تحقیقات و کسب دلایل جدید را متعهد شد. لیکن این شروط دادستان را با چالش ممنوعیت توسل به دلایل مخبرین برای پیشبرد پرونده در دیوان کیفری و ناتوانی در کسب مجوز از مخبرین برای ارائة دلایل به قضات مواجه کرد. این نوشتار درصدد است که با توجه به رویکرد دادستان، تعارض‌های احتمالی شروط قرارداد محرمانه را با مقررات اساسنامه و رویة اتخاذی دیوان کیفری بین‌المللی مورد تحلیل و بررسی انتقادی قرار دهد.

The Prosecutor of the international criminal in investigation in Congo, take an unprecedented approach. Prosecutor preferred to take informants performance instead of using the prosecutors office's personnel for research. Hence negotiated with them for confidential contract. The Prosecutor in this contract accept two conditions; privacy information and contract resources and the use of research in advance and earn new arguments were committed. But these conditions challenge the Prosecutor with the ban on resorting documents to advance criminal court records, and an inability to obtain the license of informants for the reasons provided to the judges face. This article is about the Prosecutor's approach to the conflict, according to the terms of the confidential agreement possible with the provisions of the articles of statute and the International Criminal Court taken procedural with analysis and critical review.
